The U.S. Food and Drug Administration (FDA) has not approved Kratom as a dietary supplement or for any medical use.

The FDA is actively evaluating Kratom and currently recommends against consumption of Kratom due to concerns about the risks of addiction, abuse, and dependence.

4. Kratom Product Disclaimer and Safety Concerns

Products sold by Happy Hippo may contain Kratom. Pregnant and nursing women should not consume products containing Kratom. Individuals under the age of 21 should not consume products containing Kratom; please keep out of reach of children. This product is not intended to diagnose, treat, cure, or prevent any disease.

Kratom may have addictive properties that can cause dependency issues. Please speak to a physician before using Kratom or any botanical compound.

No Implied Warranties: Happy Hippo LLC expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You acknowledge that the use of Kratom carries inherent risks and that you assume full responsibility for its use.

Limitation of Liability & Force Majeure

Happy Hippo LLC is not liable for any indirect, incidental, punitive, special, or consequential damages arising from the use of our website or products. Additionally, Happy Hippo LLC shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, government actions, war, labor disputes, pandemics, cyberattacks, supply chain disruptions, or regulatory changes affecting Kratom.

17. Dispute Resolution – Mandatory Arbitration & Class Action Waiver

A. Binding Arbitration Agreement

By purchasing products from Happy Hippo LLC, using this website, or engaging with our services, you agree that any disputes, claims, or controversies arising out of or relating to your purchase, use of our products, website, or services shall be resolved exclusively through binding arbitration.

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall take place in Boise, Idaho, or another mutually agreed-upon location.
The Federal Arbitration Act (FAA) governs the enforceability of this arbitration agreement.
The arbitrator shall have exclusive authority to resolve any disputes related to the scope, enforceability, or validity of this agreement.

B. Waiver of Class Actions & Jury Trial

By agreeing to arbitration, you understand that:

You waive any right to participate in a class action, collective action, or representative action.
You waive your right to a jury trial.
You may only bring claims against Happy Hippo LLC in your individual capacity.

If a court determines that any portion of this class action waiver is unenforceable, then the arbitration provision shall be deemed null and void, and disputes shall be resolved exclusively in Idaho courts.

By agreeing to arbitration, both parties acknowledge and agree that this arbitration clause is fair, reasonable, and mutually beneficial. Both parties expressly waive any claim that this arbitration agreement is unconscionable, unenforceable, or unfair.

C. Opt-Out Option

If you do not wish to be bound by this arbitration agreement, you must send a **signed, written opt-out request via **certified mail to Happy Hippo LLC at 2145 E Pine Ave, Meridian ID 83642** and email a copy to help@happyhippo.com within 30 days of your first purchase.

Opting out does not reinstate your right to participate in a class action lawsuit or jury trial.

18. Governing Law & Jurisdiction

These Terms of Service and any agreements for purchases shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict of laws principles.

For disputes not subject to arbitration, you agree that they shall be litigated exclusively in the state or federal courts located in Ada County, Idaho. All customer purchases are subject to mandatory arbitration as explicitly outlined above.

By agreeing to these Terms of Service, you expressly waive the application of any consumer protection laws outside the State of Idaho. The laws of other states, federal consumer statutes, or international laws shall not apply to any claims arising from this agreement.
