Why Is Kratom Controversial in US?

Despite Kratom's medicinal and recreational value, the Food and Drug Administration (FDA) has no trust in it. The agency claims to have no evidence that Kratom possesses any therapeutic potential, which further damages the herb's credibility as a medicinal product.

This prompted the Drug Enforcement Agency (DEA) to list Kratom as a drug of concern. Interestingly, its move did not deem the herb illegal. Or taken off the market even after the Department of Health and Human Services (HHS) proposal to the DEA that Kratom be listed as a Schedule 1 drug.

In the face of that, FDA raised serious concerns about Kratom side effects such as nausea, vomiting, sweating, and more. The agency thought these scenarios were reason enough to make Kratom illegal.

All the above developments provoked public hue and cry from Kratom advocates, scientists, and federal as well as state lawmakers. Later, professionals analyzed the Kratom dangers and abuse potential and concluded that its restriction was inappropriate.

Is Kratom Legal in Louisiana?

Louisiana government attempted to restrict Kratom for the first time in 2014. The bill proposed that any product or material that contains the 3 major Kratom alkaloids (Mitragynine, 7-Hydroxymitragynine, Mitragynine pseudoindoxyl) be added to the controlled substances list. But it did not see the light of day though the legislators revised and considered same bill the following year.

The 2015 new bill was passed, but its amendments removed Kratom alkaloids from the list of controlled substances. So Kratom remained legal, allowing users to continue enjoying this spectacular herb.

Things got complicated in 2018 when 3 people got salmonella from contaminated mitragyna speciosa. By God’s grace, nobody died, but the incident provoked another legislation that compelled the Louisiana Department of Health to rigorously study Kratom. Declaring Kratom a controlled substance was typically the department’s final decision.

In March 2019, another bill was proposed and passed. It targeted to criminalize Kratom if the DEA declared it or its active alkaloids illegal compounds.

Another legislation was introduced in February 2020 and gave birth to Louisiana Kratom Consumer Protection Act or KCPA (discussed later). The government really tried to restrict this precious herb, but nothing succeeded.

Kratom Bans in Ascension and Rapides Parishes

You are unlucky if you love Kratom and recently relocated to either Ascension or Rapides parish. These two Louisiana parishes deemed Kratom illegal.

Ascension parish was the first to prohibit the sale of Kratom in Louisiana state in August 2022. Initially, the legislators proposed strict restrictions on possession and consumption of Kratom but later decided to restrict only its selling.

The above state might trick you into buying Kratom Baton Rouge products and entering Ascension parish with them. Do not even think about it! To be safe, do not possess or sell Kratom in the parish.

Rapides parish was the second to restrict Kratom in Louisiana in October 2022. The parish police jury outrightly deemed Kratom illegal. You cannot sell, buy, or possess it in Rapides.

The American Kratom Association was founded in 2014 with a mission to ensure safe use of Kratom in the United States. Its main goal is to protect consumers from corporate as well as government threats.

This includes campaigning for unreasonable legal actions like restricting Kratom without solid evidence. Also, AKA ensures Kratom companies or producers adheres to Good Manufacturing Practices (GMP). Nowadays, it is also called current Good Manufacturing Practices (cGMP).

As a quick reminder, the 2020 House Bill 523 died in the committee but proposed KCPA. The AKA introduced the KCPA to set specific rules for the Kratom marketplace.

These regulations control the entire Kratom production from cultivating, manufacturing, testing, labeling of products, and selling to distribution. KCPA also monitors Kratom possession, age limits along with fines and penalties in case you are arrested.
