Kratom (Mitragyna speciosa) is a game-changing botanical. It has immensely improved lives of millions of Americans. Yet most government bodies spare no effort to restrict Kratom. It seems weird. Right?

Well, the authorities have a different view and approach when it comes to Kratom. Its legality in some states is built on sand. But wait! Is Kratom legal in your state?

Ourprevious article will answer that. Today, let us go into whether or not Kratom is legal in Louisiana.

You might be surprised when your pal tells you Kratom is legal in their region only to find out later it is illegal in your locality, and both of you live in Louisiana. No worries, Happy Hippo is here to clear all these doubts!

Overview of Kratom Legal History in the US

Kratom legality has been a hot topic since its inception in the USA. What makes it even more complicated is the varying rules and regulations in the states.

We all know the federal government creates most of the laws in the country. But it gave states a chance to make its own laws that will govern Kratom. For instance, Texas Kratom legislations are different from California ones.

Some of these states, including Louisiana, gave their counties, municipals, and other locals a seal of approval to regulate Kratom. So, when we say the legal history of this herb is hazy, that is what we exactly mean. Plus, these laws keep changing from time to time.

Why Is Kratom Controversial in US?

Despite Kratom's medicinal and recreational value, the Food and Drug Administration (FDA) has no trust in it. The agency claims to have no evidence that Kratom possesses any therapeutic potential, which further damages the herb's credibility as a medicinal product.

This prompted the Drug Enforcement Agency (DEA) to list Kratom as a drug of concern. Interestingly, its move did not deem the herb illegal. Or taken off the market even after the Department of Health and Human Services (HHS) proposal to the DEA that Kratom be listed as a Schedule 1 drug.

In the face of that, FDA raised serious concerns about Kratom side effects such as nausea, vomiting, sweating, and more. The agency thought these scenarios were reason enough to make Kratom illegal.

All the above developments provoked public hue and cry from Kratom advocates, scientists, and federal as well as state lawmakers. Later, professionals analyzed the Kratom dangers and abuse potential and concluded that its restriction was inappropriate.

Is Kratom Legal in Louisiana?

Yes, Kratom is legal in Louisiana apart from Ascension parish and Rapides parish. Do not get your hopes high because Kratom lifespan in this state has been on a knife-edge for years. Even right now, it is still the same case. Here is what we mean…

Louisiana government attempted to restrict Kratom for the first time in 2014. The bill proposed that any product or material that contains the 3 major Kratom alkaloids (Mitragynine, 7-Hydroxymitragynine, Mitragynine pseudoindoxyl) be added to the controlled substances list. But it did not see the light of day though the legislators revised and considered same bill the following year.

The 2015 new bill was passed, but its amendments removed Kratom alkaloids from the list of controlled substances. So Kratom remained legal, allowing users to continue enjoying this spectacular herb.

Things got complicated in 2018 when 3 people got salmonella from contaminated mitragyna speciosa. By God’s grace, nobody died, but the incident provoked another legislation that compelled the Louisiana Department of Health to rigorously study Kratom. Declaring Kratom a controlled substance was typically the department’s final decision.

In March 2019, another bill was proposed and passed. It targeted to criminalize Kratom if the DEA declared it or its active alkaloids illegal compounds.

Another legislation was introduced in February 2020 and gave birth to Louisiana Kratom Consumer Protection Act or KCPA (discussed later). The government really tried to restrict this precious herb, but nothing succeeded.

Kratom Bans in Ascension and Rapides Parishes

You are unlucky if you love Kratom and recently relocated to either Ascension or Rapides parish. These two Louisiana parishes deemed Kratom illegal.

Ascension parish was the first to prohibit the sale of Kratom in Louisiana state in August 2022. Initially, the legislators proposed strict restrictions on possession and consumption of Kratom but later decided to restrict only its selling.

The above state might trick you into buying Kratom Baton Rouge products and entering Ascension parish with them. Do not even think about it! To be safe, do not possess or sell Kratom in the parish.

Rapides parish was the second to restrict Kratom in Louisiana in October 2022. The parish police jury outrightly deemed Kratom illegal. You cannot sell, buy, or possess it in Rapides.

Who are the American Kratom Association (AKA)?

The American Kratom Association was founded in 2014 with a mission to ensure safe use of Kratom in the United States. Its main goal is to protect consumers from corporate as well as government threats.

This includes campaigning for unreasonable legal actions like restricting Kratom without solid evidence. Also, AKA ensures Kratom companies or producers adheres to Good Manufacturing Practices (GMP). Nowadays, it is also called current Good Manufacturing Practices (cGMP).

GMP is a system that ensures Kratom products are consistently produced and strictly regulated in accordance with high-quality standards. Essentially, it is designed to minimize risks involved in production from seed to sale.

The AKA advocacy group monitors every federal, state, county, city, municipal, or parish law affecting Kratom. Since its genesis, AKA has succeeded in implementing many Kratom guidelines and overturning legislations against it.

What is the Kratom Consumer Protection Act?

As a quick reminder, the 2020 House Bill 523 died in the committee but proposed KCPA. The AKA introduced the KCPA to set specific rules for the Kratom marketplace.

These regulations control the entire Kratom production from cultivating, manufacturing, testing, labeling of products, and selling to distribution. KCPA also monitors Kratom possession, age limits along with fines and penalties in case you are arrested.

If you are deep into the Kratom world, you know the FDA does not regulate it. Or maybe they want to do so in the near future. You never know!

So KCPA laws make sure the industry operates safely and effectively to give consumers pure and potent Kratom for a beneficial experience.

Is Kratom’s Legal Status Under Threat in Louisiana?

Kratom Louisiana history and usage do not paint a good picture to the government. Even in 2023, other parishes are looking for ways – of course, digging into the dark side of Kratom – to prohibit the substance.

For instance, St. Tammany Parish Senator is making an effort to restrict the sale and use of Kratom in the region. With all these commotions on Kratom in Louisiana, its future seems unpredictable.

Is Kratom legal in Louisiana? Yes, but under threat.

The good thing is Kratom scientists and advocates like AKA and KCPA are 24 hours active preaching the Kratom gospel to counter such threats.

Is Kratom Popular in Louisiana?

By now, you know that Kratom's popularity in the US as a new botanical for almost all conditions is unmatched. Study claims that most people may use the herb to relieve discomfort, lessen worry or uneasiness, and reduce or stop opioid use.

Kratom is undeniably popular in Louisiana in parishes where you can access it legally.

It is right to say folks who reside in Ascension and Rapides Parish and have heard of Kratom’s healing powers wish and crave to use it.

Whenever the words “ban Kratom” or “Kratom banned” are heard on the streets, Kratom advocates and even laws makers step up to help override the legislations.

Where to Buy Kratom in Louisiana

Is Kratom legal in Louisiana 2022? Bet you know the ins and outs of it.

The next big question is, where will you get top-grade Kratom products? Online or physical store?

Online is the best place to purchase potent, safe, and beneficial Kratom products in Louisiana. Ascension and Rapides parishes banned Kratom locally. Stay away from Kratom when you are in those locations.

Everybody knows the Kratom industry is expanding at quite a high speed. Different brands and products are popping up daily online and locally throughout Louisiana. Sadly, not each product sold is of the finest quality.
