The Ohio Board of Pharmacy (OBP) tried to declare Kratom illegal in March 2019, citing that 6 deaths through injection were the main reason for their decision. Later it came to light that Kratom was not the leading cause of death.

Kratom advocates and lovers fueled the authorities' decision to delay banning Kratom. In fact, the public shared at least 1500 comments and positive experiences with the substance.

In March 2022, Ohio's latest legislation, House Bill 236, commanded the Department of Agriculture to establish a Kratom production program. Its aim was to control the production processes of Kratom as well as introduce the Kratom Consumer Protection Act or KCPA. (We will discuss more later in the article).

To hammer it home, Kratom in Ohio is not a controlled substance even after a number of attempts by government to deem it so. Also, federal law does not regulate the herb.
