Do you know the Kratom market is worth $1.3 billion and expanding every day? You may not believe it when we tell you approximately 300,000 Ohioans use Kratom! In spite of that, is Kratom legal in Ohio?

Kratom legality in Ohio is murky, just like in most parts of the United States. There have been several attempts to ban it, and even now, the government is looking for ways to make that succeed.

If you love this stunning herb, you should familiarize yourself with the past, existing, and potential Ohio Kratom legal laws for safety and the best experience.

Let's get down to it.

Can You Buy, Sell, and Ship Kratom in Ohio?

Is Kratom legal in Ohio? Yes, you can freely buy, possess, sell, or ship your botanical in different counties or cities in the state. That said, it has had a rough past, and we cannot prophesy its future.

Kratom is also known by other names like Biak, Ketum, Kakuam, Ithang, Thom, Krat, etc. So do not get surprised when you hear such words in the streets and cities of Ohio.

Most attempts to ban Kratom in Ohio stem from the salmonella outbreak and misinformation.

The Drug Enforcement Administration (DEA) wanted to include kratom in the controlled substances list in 2016. Luckily, the American Kratom Association (AKA) intervened, making the DEA withdraw its move.

In April 2018, the Food and Drug Administration (FDA) reported 28 people suffered from salmonella poisoning. 11 were hospitalized, but no one died.

The Ohio Board of Pharmacy (OBP) tried to declare Kratom illegal in March 2019, citing that 6 deaths through injection were the main reason for their decision. Later it came to light that Kratom was not the leading cause of death.

Kratom advocates and lovers fueled the authorities' decision to delay banning Kratom. In fact, the public shared at least 1500 comments and positive experiences with the substance.

In March 2022, Ohio's latest legislation, House Bill 236, commanded the Department of Agriculture to establish a Kratom production program. Its aim was to control the production processes of Kratom as well as introduce the Kratom Consumer Protection Act or KCPA. (We will discuss more later in the article).

To hammer it home, Kratom in Ohio is not a controlled substance even after a number of attempts by government to deem it so. Also, federal law does not regulate the herb.

Is Kratom Legal or Banned in Other States?

Kratom is federally legal in the United States. But each state has the upper hand to draft its own laws surrounding the botanical. This makes its legality vary from one state to another.

In layman's terms, kratom is legal in some regions while highly controlled or outrightly banned in others. For instance, residents in California (except San Diego and Oceanside), Florida (except Sarasota county), Louisiana (except Ascension and Rapides parishes), Texas,… can freely enjoy kratom.

Sadly, buying or possessing any Kratom in Arkansas, Indiana, Wisconsin, and more will attract police attention.

What is the Kratom Consumer Protection Act?

The legal status of Kratom in the US occasionally changes since new laws and bills are constantly passed. Every state can adopt these regulations or create new ones. That is why individual states are getting on board with KCPA at different times.

KCPA is legislation being implemented in most states to make sure users can legally, freely, and safely enjoy Kratom. In Ohio, it is referred to as House Bill 236.

The bill passed the House of Representatives but still awaiting Senate approval. Once declared a law, it will make Kratom safe and uncontroversial in entire Ohio state.

How Can You Become a Kratom Advocate?

You can become a Kratom advocate in many ways. The primary one is to support AKA, the major Kratom advocacy organization. This includes making a donation, airing your thoughts to congress, volunteering as a Kratom protector, signing up for its newsletter, among others.

You can also preach Kratom gospel to your community (like on sites like Reddit or Facebook) or join the Kratom Consumer Council (KCC).

In the Kratom world, you can become the voice of the voiceless, as claimed by Dionne Warwick. What you do today in the Kratom campaign can improve all its tomorrows!
